18 years old
woman who admitted raping a man at knife-point earlier this year was sentenced
to 5 years on probation.
Lestina Marie
Smith from Michigan was 17 years old when she raped a 19 years old man in his
car, filmed part of the incident and threatened him with a knife and also to
share the video on social media on January11th this year.
According to
report the man said they dated for two months in late 2016.
He pledged
with the judge not to send her to prison
The attack
happened in the driveway of Smith’s step-sister’s home after an argument over a
sex tape, Smith’s defence lawyer, James F. Gust, said.
The victim
allegedly had a sex tape that he was going to put out on social media.
‘She wanted
to make one with him so that she would have one to keep him from putting his
out there,’ the lawyer said.
Smith filmed
herself as she held her victim at knife-point and forced him to perform
oral sex on her, her victim testified.
But on
Monday, Judge Andre R. Borrello – in addition to the probation and sex register
– ordered Smith to complete sex offender treatment, have no contact with her
20-year-old victim and pay the victim $1,000 (around £752).
Borrello
also ordered 313 days in jail with credit for 313 days served. Smith will spend
the next year wearing an electronic monitoring tag.
Her lawyer
said the lenient sentence fitted the situation.
Mental
health issues, lack of a criminal record and other circumstances were
additional mitigating factors, Gust said.
‘Never in
dealing with her, never did she appear to be someone who is a threat to
society,’ he said.
If the
offender were a male and the situation was the same, the sentence would still
fit the crime, he added.
